STANDARD TERMS AND CONDITIONS OF PURCHASE

1. GENERAL MATTERS

These terms and conditions of purchase are applicable to all sales of items of Alejandra Fandiño (AFM) that are made through the website www.aleniabrand.com. With fiscal direction on polígono del temple nave 41, cambre, a coruña 15,179, Spain.

Acceptance of these terms and conditions involves acceptance of the Privacy Policy and Legal Notice.

When an order is made, the person making it (the "User" or "Customer") represents that he/she is over 18 years of age and has the legal capacity to enter into agreements.

Only orders to purchase goods without the intention to resell or retail them subsequently may be made.

A. F. M. reserves the right to update or amend these terms and conditions of purchase when it considers appropriate and, accordingly, you should consult them regularly and print the up-to-date version of these terms and conditions of purchase by clicking on the links Conditions of Purchase and/or Legal Notice.

2. AVAILABILITY

All the items that the User may include in his/her order are subject to availability. If due to lack of availability or because the selected item is out of stock it is impossible for AFM to supply it, AFM will refund the User any amount he/she may have paid to purchase that item.

3. WARRANTIES

If the User enters into an agreement with AFM as a consumer, AFM offers the User a contractual warranty on the conformity of the goods on the articles sold on the Website. In any event, STL will endeavour to offer the User the most precise and reliable information on the Website with regard to the articles for sale (names, photographs, composition and attributes of the items, etc.). AFM is not responsible for any potential errors that may exist, although it will correct them once notified for such effect.

AFM will answer any complaints within two (2) years of delivery provided that the customer has informed AFM of such complaints within two months of becoming aware therefore.

4. PURCHASE PROCEDURE

4.1. REGISTERED USER

The User may browse the Website and select the item he/she wishes and, having found it, click on the item to find out the details provided on it on the Website and, if he/she wishes, add the item to his/her order.

If it is the first time that the User has accessed the Website, in order to make the purchase, he/she must register by entering his/her email address and a password, in order to create and access his/her account.

Users who are already registered and have an active account only need to enter their email address and password to access their account and for the system to recognise their data.

4.2. GUEST USER

Users also have the option of making a purchase as a guest. The purchase process will therefore be simplified for the User who, by merely supplying the essential data to process the order without being granted a specific registered user account, can make a purchase.

5. ORDER ACCEPTANCE

Once the amount of the order has been paid by the User, it will be accepted by AFM. After confirming the purchase, the User will receive an email as acknowledgment that the order has been received correctly; however, the order may be subject to verification and acceptance by AFM

The User will receive an email within 24 hours of making the order, unless there is a technical incident, confirming that his/her order has been accepted and notifying him/her of the related delivery period. Once the User has received this email including access to the standard terms and conditions of purchase, an agreement between the User and AFM will be understood to have been entered into.

6. ORDER CONFIRMATION AND CANCELLATION

Before completing the order, Users may review all the details of the order and the articles included so that, if considered necessary, they may change, add or eliminate any item.

Once the order has been formalised by confirmation thereof by the User, it will not be possible to change or cancel the order through the Website and, therefore, the User will have to contact the hi@aleniabrand.com directly. Once the User has contacted the CSD, provided that the order has not entered the shipping process and been dispatched from our central offices, it will be possible to change or cancel any issue relating to the order.

7. DELIVERIES

When making an order, Users can opt to receive it at an address.

The delivery period is approximately the specified when the order is approved. This period may increase at certain times or due to other circumstances beyond the control of AFM and, therefore, AFM is not responsible for any delays that may arise for any of the aforementioned reasons or for reasons directly attributable to third parties not connected with AFM.

Alenia offers free shipping within Spain and Portugal.

The shipping process starts once your order is received and processed. The shipment will only be processed during normal working days (i.e. Monday to Friday excluding public holidays). If your order is placed on the weekend or public holiday, it will be processed on the next working day. 

Deliveries to the Balearic islands cost 10.15€+iva, and the shipping time is 2 to 3 working days. 

Deliveries to the Canary Islands, are routed through Correos, and will cost 10.33€+iva. Estimated shipping duration is 7 working days. 

Deliveries to the United Kingdom, France and Italy will cost 14,50€+iva .Estimated shipping duration is 2 to 4 working days. 

Deliveries to all other European countries will cost 29,50€+iva.

All shipping is handled by a third party company, ENVIALIA. You can follow and track the status of your shipment on their website by simply entering the tracking number received when your order was placed.

- IMPORTANT -

Once the shipment has left our dispatch facility, it is not possible to change or alter the delivery address.

Alenia cannot be held responsible for the failure to meet the delivery durations above due to: Incorrect delivery information supplied by the customer, omission of delivery information supplied by the customer, the non availability of a person to receive the shipment at the delivery address, incorrect phone number supplied by the customer, force majeure or local events beyond our knowledge and control. 

If when opening the package, the User observes that any of the items is damaged, it should detail the damaged articles in the delivery note and contact the CSD. In such cases, AFM will repair or replace, at no cost, any article lost during transport or that has suffered any type of damage during the delivery process, provided that the User reports the incident within 24 hours of receiving the order.

Once the order has been delivered, the articles it contains will become the Customer's property and, accordingly, any damage that may be caused henceforth will be the Customer's responsibility. Any risks relating to the purchased article will be assumed by the User from the time it was delivered.

The User acquires ownership of the articles once AFM has received the corresponding amount of payment, correctly and in full, and once the purchased articles have been delivered.

8. POLICY FOR THE RETURN, EXCHANGE AND REFUND OF ORDERS

8.1. Returns using the Website

The User can access the order containing the item(s) to be returned in the "My Account" section on the website. Once identified, the User must select the item(s) in the sales receipt he/she received together with the order and choose a collection address to be provided to the courier.

If the User makes an order as a guest, they should senda n email to  devoluciones@aleniabrand.con placing the order so they can request a return. We will reply with the steps you will be required to complete in order to return your order, and the costs associated with the return. 

You can request a refund for the amount paid for the garment provided that: the garment is returned in its original packaging, the garment has all its labels intact and the garment shows no indication that is has been used. In case of not meeting the aforementioned requirements, Alenia reserves the right of not accepting the return of the item.

Once the return has been received by AFM, it will verify the returned item or items to check that they correspond to those indicated in the return receipt and that they were received in perfect condition.

If the verification is satisfactory AFM will refund the money paid by the User for the returned article(s) using the same payment method used by the User for making the order, within 10 days of notification of withdrawal.

8.2. RETURNS OF DEFECTIVE PRODUCTS

If Users return an article because it is faulty or has some type of flaw, or because it does not meet the terms established in the agreement, the return will be processed using the procedure described above, once verified that refund or replacement of the article is justified.

9. LEGAL RIGHT TO WITHDRAW THE PURCHASE

In general, if Users enter into the agreement as consumers or users they are entitled to withdraw from the agreement within (10) calendar days.

This period will expire after 10 calendar days from the date on which the ordered article was delivered to the User.

To exercise his/her right to withdrawal, the User must send a notification to AFM by email to hi@aleniabrand.com, in which he/she communicates unequivocally his/her decision to withdraw from the agreement entered into between the User and AFM.

The user must comply with all the conditions of purchase and return expressed in this document, and consequently, to exercise the right to withdraw, the articles must comply with the requirements mentioned in the POLICY FOR THE RETURN, EXCHANGE AND REFUND OF ORDERS.

During the Black Friday period, exchanges of garments prior to this promotion will not be accepted.

10. PAYMENT METHODS AND PRICE

Orders must be paid as soon as they are confirmed. Only orders for which payment has been verified and completed will be processed.

The prices of the articles shown on the Website may be changed by AFM, without such changes being applicable to orders in progress when the change was made.

Deliveries to the Balearic islands cost $10.15€, and the shipping time is 2 to 3 working days. 

Deliveries to the Canary Islands, are routed through Correos, and will cost $12.50. Estimated shipping duration is 7 working days. 

Deliveries to the United Kingdom, France and Italy will cost 14,50€ Estimated shipping duration is 2 to 4 working days. 

Deliveries to all other European countries will cost 29,50€.

All shipping is handled by a third party company, ENVIALIA. You can follow and track the status of your shipment on their website by simply entering the tracking number received when your order was placed.

Users may pay by credit or debit card (Visa / MasterCard or using PayPal.

For security reasons, if Users choose PayPal, once the order has been made no change may be made to the delivery address.

Users' payment details will under no circumstances by stored or processed by AFM, but will be directly registered by the payment gateway of the financial institution chosen by the User to make the payment. For greater security, when payment is made the Website has a Secure Ecommerce Authentication Service, a system established by Visa/Mastercard/Eurocard, whereby Customers are authenticated by their purchasing bank.

To guarantee the confidentiality and integrity of the transactions, they are carried out using the SSL (Secure Socket Layer) protocol and 128-byte security keys.

The amount of the order will be charged in real time using the chosen payment method and if the charge is cancelled for any reason and the transaction is not completed, the order will be automatically cancelled.
